al-Quran and anarcho capitalism? A new socio-political ideal!

I have recently been reading the writing on economics and politics as well as the reform of Islam for God and Qur'an alone....
I have recently read 'The Natural Republic' published by Brainbow Press and found its Quranic 'natural republic constitution' very intriguing. Also later I found one conceived by Mr. Edip Yurksel called 'Constitution of Peace Land' on the (his?) 19.org website.
I would like to start a discussion of how a quranic national socio-political and economic and civil system will compare to ideas found among the anarchists such as the anarcho-capitalists (Rothbard), anarcho-socialists and anarcho-communists and Voluntarism and libertarianism, and minarchism.
I have seen that many many commentators seem to think that the Qu'ran' command to 'consult among one another' means centralized direct democracy or a constitutional representative republic. Methinks that this position is out of ignorance to other theories that criticize against this position. I am not too familiar with the Quran as a whole. Though I know enough or am familiar enough that I am a believer (I hope!!!). So I would like help by way of criticism by the Quran only to tear my position down.
Also most people are ignorant of the difference between full laissez-faire capitalism (absolute ownership of property and ones self- no taxation at all. The funding of the gov is voluntary and consists only of police, military and law courts beyond the three branches and their institutions) and minarchism (the state takes only by force qua taxes for the bare minimum to protect against force and fraud- police, law courts and military) and also anarcho-capitalism which means that their is no central government, one owns one self and property completely and all legal and civil disagreements are handled by private institutions such as arbitrators and private protection firms.
We DO NOT HAVE CAPITALISM IN THE WEST----The economic system in the Western nations is properly called the mixed market social welfare system. It is a mix of socialism and capitalism. It is a failing system that depends on force and fraud. We have the worst of capitalism (excessive usury) and the worst of socialism (cronyism, a political class that uses the poor as stock farm animals for votes)
When we look at a Quranic socio-political system we must see (yes this is the writings of Shurer here) the difference between al-islam and al-imran. Al-islam is the universal natural spiritual nature off all things in all the universes- man, birds, tress fish etc. This is tawheed and the belief in the last day and is best encapsulated in the Surah Al-Fatihah. It is the system and religion (din) of Abraham and all the nabi and rasool. It is the ten commandments and is the natural feeling of normal human beings to goodness. (without bringing up the subject of evil, satan, etc)
(btw if I have this wrong may Allah forgive me if this is factually incorrect or a accidental misuse of terms than inshallah PLEASE point this out)
Al-imran is the specific systems and practices of religion (that Shaitan uses to make man made sects and cults from true universal din) like how, when where to do salat, what to put in the masjid, where the qiblah is, etc
The Qur'an says there will be no compulsion in al-imran. (Does it also say not compulsion in al-islam, and if not does this imply compulsion in al-islam)
All of this above was what I read in a article by a scholar named Shurer. If this is false then it is my fault--may Allah forgive me.
So now putting this altogether- we see that our basic ethics are universal but their are certain things that are revealed by the Rasool for the Believers (those who believe in God and the Last Day AND those who practice the right practices) and that their will be no compulsion in the later. Since our basic ethics are from our nature as humans and our politics must be based on our ethics some questions to me arise.

Does the command to consult apply to all men Monothiests, Monotheist-Muslims (those who believe and practice the ways of the rasool), and the atheists all together? In other words in a quranic nation can any one be a member of the government? Who can vote?

Does it imply a central form of democracy? A central government?
My ideal I will put forth will be a system not based on the Qu'ran-- (I know this is a big big big no no, this is for the sake of mental exercise) but may be compatible and I would like to build a argument for and a argument against (a dialectic?) this based on Quran alone.
Lets propose a make believe nation and lets call it 'The Republic of Smiles-a-Lot'
Their will be a constitution which will be the supreme law of the land. The constitution will stipulate that ALL LAWS in the law code and police codes shall be codified by the first Congress or the government will be disbanded. The constitution will get it ALL RIGHT THE FIRST time and it shall not be amended.---EVER
Congress will consist of a nineteen member counsel- no more and no less
Congress will have the power to declare war, make treaties of peace, set the rules of the treasury, audit all other branches of government, pass and veto amicus curie to the local governments- that will be ALL IT DOES
The president will be the commander and chief, and will work with private individuals to promote culture and science, speak for the nation that will be all the pres does, he or she will also work as a sort of mc for the pomp and ritual for the nation and will have the power to give awards and medals to deserving people
Their will be a supreme court of nineteen members who will handle causes of high treason, and other high crimes
That will be the three branches of government will do-- the central government will raise its funds from the local governments by taking a share of their earnings---IT WILL HAVE NO POWER TO TAX AT ALL---
Central governments will be run by nine member counsels and all citizens shall take part by law in town hall style meetings and MUST VOTE by law. Local governments will have the power to raise at least three COMPETING police forces, regulate local private militias, and will run a part of the national military which is run by the Nations President with consent of the Congress. Funds will be raised on by taxes at the local level. Real money in gold, silver etc will be the law of the land. There should be strict limits on taxation and since the laws of at the local level is the constitution then cronyism is mute.
The government federal and local will not spend without surplus and will not spend on debt. Their will be no public works or welfare, that is the work of religious communities. All the basic rights will be protected.
Also all police organizations, and courts at the local level will only act to regulate private competing protection agencies and arbitration and will at in defense of the poor that can not afford them and protect against these organizations if they get out of line.
This basically a federal constitutional republic with these differences-
- The federal gov does NOT tax
- The constitution can not be changed the laws are there as long as the republic stands taking away power from congress and making political parties will be useless without being banned.
The ideals of banning espionage and spying organizations, the government not influencing other nations etc as mentioned by Erksel's Constitution should be analyzed.
The question is---is this supported by the Quran? If it is then this must be a Quranic republic and all that entails if not it should be scraped as nothing but the whisperings of satan and deleted from our minds, computers etc.

all the systems you have listed and the ideas they promote are based on a simple idea, that in law there is a collective right and an incorporeal entity can contract with a man or woman without them being a party to the contract, but binding them to that contract without their direct consent.
Firstly you have to understand the law, and not get confused with the above notions, which are against the law, all legislation is a contract making something that is lawful, unlawful, or making something unlawful, lawful, within positive law, however that contract is imposed through positive law, and is not the law of the land.
This is the trick of the accumulated wealth elite, they hide the law, and impose legislation. This means they create positive law, which is law imposed through the authority of the master over the slave.
The first thing to understand is the law is inalienable, and immutable, there is NO collective rights, at all, and you can ONLY contract with another tangible living man or woman, not an abstract fiction of State, corporation, church or any other invented body.
You are ONLY bound to a contract you are a direct party to, that is witnessed and binding.
The Qur'anic system is based upon the law of the land, also known as the Natural law, I have written a contract of community presenting the natural law, this is the foundation of an Islamic community, this removes the frauds of ownership, corporation, estate, taxation, usury, legislation, charter, statute, nations, countries and capital.

When I saw your post having the "Anarcho" bit in it, I got excited, but then I read your post and you still talked about a government.
I am a firm supporter of anarcho-capitalism, that is void of state altogether. I do not believe that the government has any need for existence - I believe it to be an unnecessary evil. I also believe in the idea of Austrian economics.
The anarcho-capitalism system lives off the single principle that you cannot initiate the use of force onto others. That is its law. There is no need for a lengthy document.
You talk about a constitution, and a delegation of people. That still makes it a government. You talk about the ability of a state to declare war and make peace. How will the govt create standing armies if there is no taxation? You talk about high treason? Treason won't be possible in an anarchist system. I think the views you have described are more libertarian than anarchists.
I believe that only Anarcho-capitalism offers true absolute liberty and freedom for people.

law does not need inventing, it is a natural order born from two simple principles, do all you have agreed to do, that is the basis of all contract law, do not encroach upon another, is the basis of all criminal law.
The natural prescriptive law of the land is inalienable and immutable, as it is founded on reason based upon natural order, the law cannot impose it can ONLY protect, is the first, you can only contract with a living tangible man or woman, is the second, your right to contract is unlimited, and you can seek remedy and recourse through a court of your peers.
The system of compliance is also simple, based upon a surety bond contract between members of the local community you exist within, and the allodial right of use system removes the fraud of ownership. these ideas are the true Islam, and were in use for many centuries in the past.

Anarchism and capitalism cannot exist side-by-side because eventually a law will need to be passed to keep business from encroaching on the rights of the individual. In American history, the rise of monopolies and Rockefeller's tactics in dealing with smaller petroleum busineses should show the true nature of capitalism. Not to mention the lawless and stateless capitalism that goes on in Mexico known as gang-driven drug trafficking. God's commands limit capitalism to ensure that the practice of buying and selling does not transgress the limits of what is just.

But that is entirely incorrect. Do not confuse corporatism with capitalism. Governments create monopolies. The majority of the monopolies today exist precisely because of government. Companies like British Telecom (BT), Royal Mail, national rail, NHS etc are monopolies, and became monopolies because of state intervention. The example you gave of Rockafellar abusing its position in the market place is precisely because of state intervention. It is corporatism, not capitalism.
The free market on the other hand always creates an alternative.
Yes there is a few monopolies in the private sector e.g Microsoft with Windows. But are we deprived of choice here? Linux is a free operating system and equally as powerful. But the choice here for corporations is levering risk with cost. Yes Linux maybe free, but support for linux will be more difficult that Microsoft. But for the poor, the ones that cannot afford Windows, can have Linux - for free! Is this wrong?You forget that capitalism is VOLUNTARY. It is not forced. It is a transaction between 2 or more people coming together. I do not know of a system better than this that God would prefer. There is choice. You are not deceived. You are not forced.
Your example of drug trafficking, is precisely because the state controls the drug trade. If people were able to grow drugs in their back garden, it won't lead to mafia's and these outrageous prices because the state permits certain companies to be in the drugs trade and not others.Capitalism is JUST. Socialism is anything but.
