    This is the contract my wife and I worked to create using the Quran only as our guidance. We both worked on this so we both understood what we were undertaking as a couple.

    Marriage Contract
    For those who submit their will to The God,
    the Beneficent, the Merciful
    ?And of His signs is that He created for you, of yourselves, spouses, that you might repose in them, and He has set between you love and mercy. Surely in that are signs for a people who consider.? Surah 3021

    Confirmation of a contract of marriage based on mutual consent and agreement between , born and of marriageable age according to civil law, and , born and of marriageable age according to civil law, concluded on at in the presence of and .

    ?And marry not the females who deify until they believe. And a handmaiden, one who believes, is best from one who deifies, even if she pleases you. And marry not the males who deify until they believe. And a servant, one who believes, is best from one who deifies, even if he pleases you. Those, they invite to the Fire, and The God invites to the Coverings and the forgiveness, by His leave. And He makes clear His signs to the men, so that they may take heed.? Surah 2221

    Declarations Relating to Marriage

    ?And make not The God a turning away to your oaths from your righteousness, and beware, and reform between the men. And The God is Hearing, Knowing.
    The God will not call you to account for the vain in your oaths, but He will call you to account for what your hearts earned. And The God is Forgiving, Forbearing.? Surah 2224-225

    DECLARATION THAT WE ARE FREE TO MARRY
    We, and , each declare that today we are not married to any other person. We declare that we are not married by civil marriage, nik?h or any other type of marriage in any country or jurisdiction.

    DECLARATION OF MONOGAMY
    ?And go not near the adultery. Surely it is an immorality and an evil way.? Surah 1732

    We, and , each declare that we will not try to marry any other person by either civil or marriage of any kind while this marriage exists and while each of us can exercise a right of divorce.

    If the act of adultery were committed by , he is responsible for fulfilling the full term and financial obligation (faratan) of the contract.

    "And whoever is not able to afford among you to marry the ones who are guarded of the ones who believe then from what your oaths control of your youths of the ones who believe. And The God knows best about your faith. You are from another. So marry them with permission of their family and give them their reward in kindness as ones who are guarded, not ones who fornicate or ones who take paramours. So when they are protected, if they then commit immorality, then unto them half of the punishment of what is on the ones who are guarded. That for whoever fears the difficulties among you. And that you be patient is better for you. And The God is Forgiving, Merciful." Surah 425

So the good deeds obedience, guarding of the unseen that which guards of The God. And those whom you fear rebellion, then teach them, and avoid them in the bed and set them forth.     DECLARATION OF OBEDIENCE
    We, and , believe that the equality of a wife to her husband is part of a marriage of those who submit their will to The God, the Creator who revealed the Arabic Quran; a guidance to all mankind. We promise to build a relationship based on service to The God, on equality, and on respect for each other. We promise that we will consult with each other and that neither one of us will have special authority or power over the other.

    ?Women are a tilth for you, so come to your tilth how you both will, and send forth for yourselves. And beware The God, and know that you are ones who will meet Him, and announce of the ones who believe.? Surah 2223

    DECLARATION OF NO FORCE OR VIOLENCE
    We, and , each declare that we will not use violence of any kind in the marriage and that we will not use force or pressure in our personal relations. We also confirm that each of us has a full right of choice in matters having to do with intimate relations.

    ?And The God has favored some of you unto others in the provision. So those who were favored turn over of their provision unto whom they control of oath, so they are in it equal. Or in the favors of The God do they deny?" Surah 1671

    DECLARATION OF EDUCATION AND WORK
    We, and , agree that each of us has the right to further our education and to work as we choose.

    DECLARATION OF HOUSEHOLD RESPONSIBILITIES
    We, and , agree in principle and in a spirit of open cooperation that we will divide housework equally. We will take into account the duties each of us has outside the home, such as those related to work and education. We each agree that we will be respectful and constructive if we need to talk about any inequality or unfairness.

    ?The God has not made for man any two hearts inside him. And he has not made your spouses to whom you support from them of your mothers. And He has not made your calling your sons. That is your saying with your mouths, but The God says the truth, and He guides the way. Call them by their fathers; it is just with The God. But if you know not their fathers then your brothers in the conduct and your friends. And not upon you is any blame in what you err in it, but what your hearts intend. And The God is Forgiving, Merciful.? Surah 334-5

    DECLARATION OF CHILDREN
    We, and , agree to treat all children of current and former relationships as our own, being equitable and just between them all. We, and , also agree that our children have the right to keep the surnames of the fathers who sired them.

    Part Two
    Declarations Relating to Religious Divorce
    DECLARATION OF SEEKING RECONCILIATION BEFORE DIVORCE
    We, and pledge that if either of us is considering a divorce, the parties will contemplate seeking reconciliation before drawing up the written declaration of divorce, in accord with the revelation of The God found in the Quran, in Surah 435
    ?And if you fear a schism between them, then send an arbitrator from his family and an arbitrator from her family. If they desire reform, The God will reconcile between them. Surely The God is Knower, Seer.? Surah 435

    DECLARATION OF DIVORCE IN WRITING
    We, and , pledge that if either of us wants to have a divorce, the person divorcing will write up a paper document that is signed, dated, and notarized or commissioned. They will write, sign and notarize or commission the statement of divorce as soon as the divorce is started and make sure that it is delivered to the spouse being divorced within seven (7) days of that date. We understand that this declaration does not make or begin a civil divorce and that we must take other action to get a civil divorce.

    ?For those who forswear from their woman, a wait of four months, then if they return; then surely The God is Forgiving, Merciful. And if they decide the separation, then surely The God is Hearing, Knowing.? Surah 2226-227

    If seeks divorce, he must announce this intention and separate himself from . will not enter into coitus with during this time to ensure no progeny are created during the separation period.

    ?And the ones who are separated shall wait by themselves three recitals. And it is not permitted for them that they conceal what The God created in their wombs if they believe in The God and the Day of the Afterlife. And their husbands are truer in taking them back in that, if they desire reform. And for them similar; that which is on them with fairness, and for the men, on them a rank. And The God is Mighty, Judge.? Surah 2228
    ?And those who despair of the menses from your women, if you doubt, then their number is three months. And the non-menstruated and those of the pregnant, their term is until they deliver their burden. And whoever fears The God, He will make for him from his affair ease.? Surah 654

    The divorce will become final after a waiting period (iddatin) of four months. During that time will wait three recitations of the Quran ? three lunar cycles ? or until the end of her next menstrual cycle, which ever occurs first, to ensure no progeny were created prior to the separation period.

    ?The separation is twice, then to retain with fairness or to release with kindness. And it is not permitted for you that you take whatever you have given them of anything, except if both fear that they cannot keep The God?s limits. So if you fear that they cannot keep The God?s limits, then no blame on them in what she ransoms in it. These are The God?s limits, so transgress them not. And whoever transgresses The God?s limits, then those; they are the defilers.? Surah 2229

    We, and , will only seek separation with hope of reconciliation twice during the entire course of our marriage. Upon the third decision for separation, divorce will be the final result, without any opportunity to reconcile during the waiting period.

    ?Lodge them from where you inhabit from your means and do not harm them to distress upon them. And if they are pregnant folk, then spend upon them until they deliver their burden. Then if they suckle for you, then give them their payment, and consult between yourselves in kindness. But if you disagree, then another may suckle for him.? Surah 656

    I, , pledge that I will fully maintain my wife at least until the end of her waiting period, in accordance with Surah 656.

    I, , pledge that if is found to be pregnant after separation is pronounced, that I shall support her fully until the birth of the child, in accordance with Surah 654 and Surah 656.
    I consider this undertaking to be a religious and moral obligation in addition to my civil obligations under the law.

    ?And if you desire replacing a wife in place of a wife and you gave one of them a heap, then take not away from it anything. You would take to you slander and a manifest punishment.? Surah 420

    We, and , agree that in accordance with the teachings found in Surah 2229 and Surah 420, upon divorce outside of adultery, in the case of obligation (faratan) remaining it shall be continued to be paid for the remainder of the 8 year term, without any part subtracted.
    Upon divorce outside of adultery, in the case of the obligation (faratan) given as one lump sum paid upon date of marriage, no part may be subtracted.

    mahr will be due when the civil divorce is final.

            The divorce will become final after a waiting period (iddatin) of four months. During that time will wait three recitations of the Quran ? three lunar cycles ? or until the end of her next menstrual cycle, which ever occurs first, to ensure no progeny were created prior to the separation period.
