Divorce: A few questions
-
Peace Layth,
Just some thoughts on the divorce article...
"If he divorces her again (for the third time), it is unlawful for him to remarry her, unless she marries another man, then he divorces her. The first husband can then remarry her, so long as they observe GOD's laws. These are GOD's laws; He explains them for people who know." (2/230)
I dont like the brackets! God didn't say third time ?
Divorce is a single event. There is a beginning, an interim period and a conclusion. Divorce would be twice (the beginning and the end) and not three times as has been traditonally believed.
The first divorce would begin the waiting period (its the decision to divorce but you have to wait for 4 months)...
For those who wish to divorce their wives, then they must wait for four months. If they retract, then God is Forgiving, Most Merciful. (2/226)
The three menstruation period is exceptional and reconciliation is possible in cases of pregnancy...
And the divorced women shall hold themselves for three menstruation periods; and it is not lawful for them to conceal what God has created in their wombs,...(2/22
If you choose to 'execute' the decision of divorce and separate thats the second and final divorce...
"Divorce may be done twice. The couple either reconcile equitably, or go through with the separation equitably...." (2/229)
God gives you time to reconcile. If you don't and the time for reconciliation is passed and you have separated then there's no going back.
"If he divorces her...(2/230)" which means if they decide to EXECUTE the divorce after the waiting period and separate...then they cannot remarry UNLESS she marries another man and he divorces her...
If people knew they could remarry then there would be no point to the waiting period...since the waiting period in that case wud be indefinite.
Also...if the second divorce (or separation) does not take place then the divorce was not executed (it didnot happen)...the decision was changed and the couple reconciled...no matter how many times they do this is irrelevant. Its like a 'proposition' that was taken back before it became a 'law'.
