    What is the theft punishment in Quran? This article will show, God willing (Gw), that is to give the chance to the thieves to come forward, acknowledge their crime, and give back what they have stolen to the victim. They might even get a reward. If they do not come forward, prove should be found who are the thieves. Then thieves should then work to pay the fees involved for the whole thing. What was stolen, if found, should be restituted to their owners. Otherwise, thieves should work for them until what they have stolen is repaid. First, the article will explore the two classical understandings related to this issue and show their shortcomings. Then, it will conclude with the third and the closest to Qurans spirit understanding just stated.

    So far, two punishments for theft were proposed as an understanding of aya 538.

    538, "The male thief, and the female thief, you shall "eqtau" (in Arabic) their "aydiyahuma" as a punishment for their crime, and to serve as a deterrent from GOD. GOD is Almighty, Wise."

    Meaning of both Arabic words above will be given soon, Gw.

    The first understanding says that 538 means to cut off the thief's hand. First, the Arabic "aydiyahuma" is the plural of "yad" (hand) used in dual form. Should we then cut off both hands of a thief?

    If the quran wanted THE hand to be cut off it would say "cut off one the hands" as in another verse it says "cut off the hands and feet on opposite sides".

    So we must conclude that it means an alternative explanation NECESSARILY.

      O you who believe, equivalence is the law decreed for you when dealing with murder - the free for the free, the slave for the slave, the female for the female. If one is pardoned by the victim's kin, an appreciative response is in order, and an equitable compensation shall be paid. This is an alleviation from your Lord and mercy. Anyone who transgresses beyond this incurs a painful retribution.

      2.194. The prohibited month for the prohibited month,- and so for all things prohibited,- there is the law of equality(Qisas). If then any one transgresses the prohibition against you, Transgress ye likewise against him. But fear Allah, and know that Allah is with those who restrain themselves.

      So for someone who is to be amputated his crime of theft should be a equivalent to the value of a loss of a hand. Thats quite a value. Every human being I know values his hand very highly. He would rather lose his home than his hand. So amputation can not be correct.

      And eye for an eye, tooth for a tooth and a soul for a soul.

      A hand for a hand also or any equivalent value or retribution instead.

      For murder we are given a soul for a soul as the highest ceiling and then exile from the community as the lowest ceiling. Amputation is allowed for murder if we do not want to execute (Cain and Abel story in the Koran).

      We are to fight those who fight against us but not to transgress. Forgiveness is always allowed except for murder where exile from the community is the lwoest ceiling.

      We are always to judge by qist and adl, justice and equity. No excesses allowed.

      We are also to

      Wa la taziru waziratun wizra ukhra? (Nor can a bearer of burdens bear another's burden),

      Tribal justice is not allowed where retalitaion is done againt anyone for the tribe to which the criminal comes from.

      Eye for an eye tooth for a tooth,
      man for man, women for woman and slave for slave
      apples for apples, oranges for oranges and grapes for grapes.

      We must not mix apples with oranges or eye for an eyelash and a tooth for a jaw.

      The Koran uses these terms to indicate euqity and proportionality when it comes to justice.

      55.9. So establish weight with justice and fall not short in the balance

      Here it says we should establish qist when it comes to weight(wazn) and not lose the scale(mizan). That is why justice is symbolized by a scale.
