Can Males Only Testify in Adultery Cases?
-
Salaam,
Can males only be witnesses in cases of adultery?
I believe that females can aswell, but I think someone is trying to argue that only males can... Does the arabic suggest this aswell?

The Quran was never specific to the gender of the witnesses for adultry witnessing however it did with I believe the "inheritance" where as far as I remember it says the witnessing of one man may be substituted with the witnessing of 2 women, if we use this verse for adultry then 4 men = 8 women for witnessing
this is just an idea that is not well founded and can be a conjecture easily however i only stated it because it relates to the gender of the witness

My understanding of the issue on the witness gender is that the only instance where Quran is specific to the gender of the witnesses is in the case of business transaction and more precisely reporting or writing debt. My understanding is based on verse 2282.
So in the case of adultery, since the gender is not specified therefore 4 men witnessing = 4 women. It is interesting to note verses 246 to 249, the numbers of bearing witness (shahadattun) are equally applied to both the wife and the husband. It is also interesting to note that if the man is a liar, God's reaction is a curse (la3'nattun) on the husband and if the woman is a liar, God's reaction is anger (ghadhab) toward the wife. Any better understanding as to what could be the reason behind this differentiation? I don't want to speculate, but one thing that I could think of is MAYBE because men are inclined to accuse women quickly than women? I noticed in almost all cultures, when something goes wrong, women are quickly accused of "whores"-) while in fact it has nothing to do with sex. And God the All-Mighty knows best.
Any possible explanation is welcome. Peace. Myr. -

I never even noticed the difference of God's judgement between genders in this verse! Gazaky Allah kheir sis thanks for pointing that out. I agree with your analysis that women get the heat more .. it could be true!
It would be interesting to see some more interpretations of this difference )
May God increase you in knowledgePeace All

Salaam Myr, all
That's an interesting observation. I would add that this verse is applicable to both genders, as in the case where the woman accuses her husband (I do not recall a verse parallel to this situation in the case of an accused husband). The reason in the difference in God's reaction could also be that it is more serious to accuse people than to defend yourself. The adultrer is not being fair on him/herself, but the accuser is not being fair on him/herself AND on the accused.
And God Knows best.
