I have scanned in a few pages of Islamic Legal Theories by Prof. Wael B Hallaq where he discusses Muhammed Shahrours Legal theory. He calls Muhammed Shahrour's ideas the solution to the Muslim world. His insights are very intruiging.

They are from this book by Professor Wael B. Hallaq who is professor at the Institute of Islamic Studies at McGill University. The same university where the famous Professor Toshihiko Izutsu who wrote "God and Man in the Koran".

Thank you Arnold for the pages. From what I read, I see Sharour has similar understanding with Rashad in severa issues; except he coins some new terminologies or uses some scientific metaphors while defending them. Another difference, I noticed that he does not reject hadith and sunna outrigtht as Rashad did, yet he does not care about them either.

When I met him last September in London, he said to me "Only study the Arabic language and science, screw everything else." He does reject them completely, he told me clearly in my 3 hour interview. He doesn't reject them directly in his work is because he wants to create a system where in Muslim countries can slowly let them go. He knows letting go of Hadith takes time, so he created a legal system which urges the users of it to let them go when they are unusable in a modern society. His concepts of Limits in society makes the legal system only depend on the Quranic Limits, and the justice department themselves can decide themselves where to be within those limits. So they become independent of Hadith, and only use reason and their own concept of what is needed in every legal case.
But he also proves with his concept of the difference between Nabi and Rasul, that Muhammed could never had made an ever-binding command. His theories show that orders given by Mohammed were only restricted to his time, and not after him. So without attacking Hadith directly, he undermines their authority by proving Mohammed's authority never extended beyond his own lifetime, thus making Hadith & Sunna non-binding for us.

I never understood the concept of Islamic legalism and what does it have to do with the Koran. I am not aware if this is even a Koranic concept. I know God legalism such as His commandments are Koranic which we will answer to in His court on judgement day. But what exactly is Islamic legalism?
