    Simple,

It is about the final separation as husband and wife; who shall quit the house according to 65 1?

    Peace.

    .

If we take bait as you say!

" nor shall they (themselves)leave" why shouldn't they leave themselves if they don't get along?Which is more Godly?

"unless they are guilty of a shameful act" Then you can push them out, irrespective of whether they have a place to go or not? is that Godly?

bait can't be a physical house- as its used in the example i gave aswell.

In this case it's the marriage contract- and the prophet is being told don't anull the marriage accept through the proper process , as the ayah is explaining.

please see the previous example as well.

    peace

"unless they are guilty of a shameful act"

A shameful act that could be proven, and in the house where her children are? And you worry where she goes? Maybe to prison. If the husband is not there, and spying is forbidden, this shameful act must be very well known. If she does not respect the fact that her former husband has been removed from the house (and he may have no other place to go), why would she be favoured and kept in a house she does not rspect?

Why does it have to be very well known?

If she does not respect the fact that her former husband has been removed from the house

Why does he need to have been removed? might be an old or a blind man or something.

(and he may have no other place to go), why would she be favoured and kept in a house she does not rspect?

She may not be old enough, or may not have enough common sense, to know better and it may be the very first time in her life ever! you can think of so many think.

Does the ayah mention any of these things you brought up though?

I thought all the ayah is saying is give the women their time before you finely remove them from your marriage, as i think the quran depicts somewhere.

Its not about booting someone out of your house but if it came to that,in case of an indecent act you are given leave to boot them from your life but in a Godly way- i think.

        peace

        God Bless.

Why does it have to be very well known?

Because you missed this word in your translation

"unless they are guilty of a shameful act" Then you can push them out, irrespective of whether they have a place to go or not? is that Godly?

          Which means evident/ proven/

Why does he need to have been removed? might be an old or a blind man or something.

I think once they are divorced, he is a stranger. The verse sets general guidlines, so if he is blind or pld, he "qur'aanic" state should have a solution for him. Does this mean he stays and she serves him because he is blind and/or old?

She may not be old enough, or may not have enough common sense, to know better and it may be the very first time in her life ever! you can think of so

Judt like the above. As long as the person reached the age of maturity to get married they are responsible for their actions. Any factor that may play in their favour would be dealt with in court, unless you believe that a husband can signlehanded isue the divorce and take these actions, which I do not agree with.

Sorry Samia i was editing it. You missed the final version.

And then again it might be her house, so he couldn't kick her out but could still remove her from the marriage tie.

            peace

"he" could not remove her from the marriage tie by himself alone according to the qur'aan. Whether he feared arrogance from her (minimum reason) or saw her committing aultry (maximum case) he has to go through the whole process in front of a judge or an authority.

Say what? That in case of fear of arrogance (nushuuz)they should bring a mediator from her side and one from his side, or where one accuses the other of adultry they should prove/refute it by 4 oaths?

Not for adultry, I did not say that, but for "nushuuz" . For adultry it's 4 oaths. Unless you think after all this they return home and live happily ever after. (sorry I do not have my qur'aan with me )

                        4 35

And if you fear a breach between the two, then appoint judge from his people and a judge from her people; if they both desire agreement, Allah will effect harmony between them, surely Allah is Knowing, Aware.

                          Sorry Br.

?AND IF YOU FEAR A BREACH BETWEEN THE TWO? The judge in case of a breach- a series disagreement between the two or if one breaks a rule or law.

                          3352
It is not lawful for thee (to marry more) women after this, NOR TO CHANGE THEM FOR (OTHER) WIVES, even though their beauty attract thee, except any thy right hand should possess (as handmaidens) and Allah doth watch over all things.

If you want to change a wife- for whatever obscure reason then there isn?t a breach as no one is in disagreement and hasn?t broken any laws.

                          peace

What are you sorry about? Speak your translation i.e., the way you had understood 4 35 as against the way I have understood and reveal the discrepancy in such a manner that the way I had understood if practiced will lead to disaster.

                              Salaams drfazl,

                              651

O prophet when you divorce women so divorce them at their prescribed periods and count their periods and fear Allah your lord not turn them of their beyootehunna/ marriage tie and nor shall they come out except that they commit indecency clear and those are the limits of Allah snd whosoever transgresses the limits of Allah?????

The ayah itself is giving us the subject ? ?that is the period for devorce? it?s not about them being evicted from their houses or your houses , you can?t evict them from their houses anyway nor do they need to come out of their houses.

                              The subject matter continues-
                              652
Thus when they fulfil their term appointed, either take them back on equitable terms or part with them on equitable terms; and take for witness two persons from among you, endued with justice, and establish the evidence (as) before Allah. Such is the admonition given to him who believes in Allah and the Last Day. And for those who fear Allah, He (ever) prepares a way out,
                              653
Such of your women as have passed the age of monthly courses, for them the prescribed period, if ye have any doubts, is three months, and for those who have no courses (it is the same) for those who carry (life within their wombs), their period is until they deliver their burdens and for those who fear Allah, He will make their path easy.

                              God Bless.

                                Simple,

The way I had translated has not caused injustice to women or men and the application is well within the sphere of Islam, the practice of peace. The way you have given as the meaning to the ayat is silent on that part of 65 1 that speaks of what to do when the separation is over.

                                Salam.

Well Br if its not there then its elsewhere!

                                  for example;

                                  652
Thus when they fulfil their term appointed, either take them back on equitable terms or part with them on equitable terms; and take for witness two persons from among you, endued with justice, and establish the evidence (as) before Allah...........

Now if AFTER THE TERM they want sepration then your judges come into play; those endued with justice.

                                  And

                                  4 35

There is no house in 65.1

And God doesn't care about your houses but does care about your contracts.

I think i will leave you with your house
