I hope we're not interpreting an ayat according to our interests.. like, saying hell isn't forever or it is on earth, just because God doesn't show us the true logic of it...
Alright, resolve the slight problem of "repenting" after your hands have been cut off, and get back to me.

Our duty is as decribed in 538,
while 539 is saying simply what it says..
no contradiction, no complication..538 is a concept of you reap what you sow/ cause and effect, while forgiveness/repentent is a different story.
for example, someone gossiped about you, you found out about it and the knowledge creates resentment/embarrasment.. but then it is up to you to forgive or not.. resentment/embarrasment is bound to happen..cause and effect.salam.

In above verses, what was held back/restrained is their ?hands? or means to carry out.
Likewise, for known thieves; i.e. repeat offenders; cut off their means to do so.
Prison is certainly an option.
Question for professional thieves in 7th century Arabia is the ?literal? severing of hand a way to cut off their means to perpetrate their crime?

Again, the beauty of the Quran is that the first meaning would hold in that time, the second meaning fits in today, and in a few hundred years, when technology so advances, we can use both meanings!
But, clearly the meaning to "cut off means of wealth" is better throughout.

Cutting thieves hands is horrendous and barbaric. Perhaps the verse 538 and especially 533 may have been painfully and unduly misunderstood in my opinion.
yea but some people deserve it i.e. people that claim to be raising millions of ??????? for charity and pocketing most of it.
If the crime was caught on camera (these days it usually is) then claiming that the accused is innocent is just ridiculous.

The notion that someone "deserves" amputation of the hand is highly subjective. There are people in this world who see nothing wrong with stealing...

The forgiveness part is crucial. It implies that the punishment should be reversible, in case the thief repents. Cutting hands seems fairly irreversible to me. What do you think?

IMO that is not true. I remember discussing this with my mum, her understanding was that forgiveness means "letting them off", this IMO only makes sense if the punishment is amputating the hand. If a thief is locked up for about 3 months, they have served their time, we cant punish them after their 3 months is up, letting them off and not sending them down for 3 months is too forgiving, it will not make the problem go away.
There are people in this world who see nothing wrong with stealing...
if the person is poor we can't really blame them (although I can't exactly condone it). However it is the duty of the state to provide for the poor.

The roots for "faiqtaAAoo" and "aydiyahuma"
Qaf-Tay-Ayn = to cut/sever/disunite/separate/detach, to disable in prosecuting, unable to proceed in, withdrew, break down, perish/cease/finish/fail, cut short / stop, intercepted/interrupted, put an end/stop to, a piece/bit/part/portion cut off from a whole, herd, distinct portion.
Ya-Dal-Ya = to touch, aid, do good, be beneficent, show power and superiority, a hand. By his agency/means.
With a willing hand, out of hand, having financial ability.
In acknowledgement of the superior power, in ready money and not in the form of deferred payment, considering it as a favour, on account of help, (payment should be made by the hand of the parties themselves without the intervention of a third party and without reluctance.

suqaita fi aidihim (idiomatic expression) they repented, the idea seems to be that they hit their fingers in grief and contrition.
Handy, Might, Power, Superiority, Benefit, Possession, Favour, Generosity. The idea behind those expressions is that the use of the hand is the real source of the superiority and power. Under his authority, upper hand, arm, foreleg of a beast, handle of a tool, wing of a bird.
